Our Commitment To Childrens' Privacy
The Website is not targeted or directed at children under the age of 13 and FLATS® will not knowingly collect personally identifiable information from children under 13 without prior and direct parental consent pursuant to the Children's Online Privacy Protection Act (“COPPA”). These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by FLATS® without restriction or notice.
At any time, we may amend these terms and conditions of use (including by modification, deletion and/or addition of any portion thereof). If we make a material amendment to these terms and conditions of use, we will notify you of such amendment by sending you a message at your username account. Any such amendment to these terms and conditions of use will be effective thirty (30) calendar days following either our dispatch of a-notice to you or our posting of notice of the changes on the sites.
XI. Governing Law, Jurisdiction, and Venue
You agree that any action at law or in equity arising out of or relating to these terms and conditions of use or the FLATSlife website shall be governed by the laws of the State of Illinois, without giving effect to any principles of conflicts of law. You also agree that any action arising hereunder shall be filed, and that venue properly lies, only in state or federal courts located in Cook County, Illinois, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. We do our best to ensure that our Content on any FLATS® Site is appropriate or available for use in any particular location. However, those who choose to access the FLATSlife site do so on their own initiative and are responsible for compliance with all applicable laws including any applicable local laws.

FLATS® LLC. fully support the principles of the Fair Housing Act (Title VIII of the Civil Rights Act of 1968), as amended, which generally prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status (including children under the age of 18 living with parents of legal custodians, pregnant women, and people securing custody of children under the age of 18), and handicap (disability)

ApplicationIN COMPLETING THIS APPLICATION, YOU ARE APPLYING TO LEASE AN APARTMENT WITH FLATS®, LLC AND WILL BE DELIVERING PERSONAL INFORMATION TO FLATS®, LLC INCLUDING, BUT NOT LIMITED TO, YOUR LEGAL NAME, DATE OF BIRTH, AND SOCIAL SECURITY NUMBER. BY AGREEING TO THESE TERMS AND CONDITIONS, YOU EXPRESSLY AGREE TO HOLD HARMLESS FLATS, LLC FOR ANYTHING RELATED TO THE PEROSNAL INFORMATION DISCLOSED HEREIN.
ELECTRONIC SIGNATURES HAVE THE SAME LEGAL EFFECT AS INK SIGNATURES ON HARD COPIES. BY TYPING MY NAME IN THE FOLLOWING BOX I CERTIFY THE ABOVE STATEMENTS TO BE TRUE AND CORRECT, TO THE BEST OF MY KNOWLEDGE.

AN INDEPENDENT THIRD PARTY WILL CALCULATE DEBT TO INCOME AND RENT TO INCOME RATIOS TO HELP DETERMINE AN APPLICANT'S ABILITY TO ACCEPT FINANCIAL RESPONSIBILITY FOR THE LEASE.
EVICTIONS WILL RESULT IN AUTOMATIC DENIAL.
BY SIGNING, YOU ACKNOWLEDGE THAT YOU HAVE HAD AN OPPORTUNITY TO REVIEW OUR RENTAL SELECTION CRITERIA, WHICH INCLUDE REASONS YOUR APPLICATION MAY BE DENIED, SUCH AS CRIMINAL HISTORY, CREDIT HISTORY, CURRENT INCOME, AND RENTAL HISTORY.
The Premises shall be occupied exclusively for residential purposes by Lessee and the other persons specifically listed in the Application and any children which may be born to, or in the legal custody of Lessee during the Lease Term. Unless agreed to in writing signed by Lessor, no person any occupy the Premises for more than a single two week period, during any single year in the Lease Term, unless listed in the Application or they will be deemed an unauthorized resident. Neither Lessee, nor any person in legal occupancy of the Premises, shall perform or permit practice any which could cause damage to the Building, Lessor or other occupants, lessees of the Property or Building, or be injurious thereto, illegal, immoral, or increase the rate of insurance on the Property or Building. At no time during the Term of this Lease shall more persons reside in the Premises than would be permitted by the applicable building or zoning codes for the City of Chicago. Use of the Premises, or any such application to use the Premises, as a Shared Housing Unit (as that term is defined in Section 4-14-010 of the Municipal Code of Chicago), Vacation Rental (as that term is defined in Section 4-6-300 of the Municipal Code of Chicago) Shared Housing Units, AirBNB, short-term rental arrangement and/or rooms for rent (each a “Short Term Rental Arrangement” and collectively the “Short Term Rental Arrangements”) are strictly prohibited under this Lease. At no time shall Lessee enter into, make an application or attempt to enter into any Short Term Rental Arrangement similar agreements for the Premises. Any such Short Term Rental Arrangement shall be considered a breach of this Lease and cause for termination.
YOU UNDERSTAND THAT IF YOU DO NOT MEET OUR RENTAL SELECTION CRITERIA OR IF YOU FAIL TO ANSWER ANY QUESTION OR GIVE FALSE INFORMATION, WE MAY REJECT THE APPLICATION, AND RETAIN ALL APPLICATION FEES AS LIQUIDATED DAMAGES FOR OUR TIME AND EXPENSE, AND TERMINATE YOUR RIGHT OF OCCUPANCY.
GIVING FALSE INFORMATION IS A SERIOUS CRIMINAL OFFENSE. IN LAWSUITS RELATING TO THE APPLICATION OR LEASE CONTRACT, THE PREVAILING PARTY MAY RECOVER FROM THE NON-PREVAILING PARTY ALL ATTORNEYS' FEES AND LITIGATION COSTS. WE MAY AT ANY TIME FURNISH INFORMATION TO CONSUMER REPORTING AGENCIES AND OTHER RENTAL HOUSING OWNERS REGARDING YOUR PERFORMANCE OF YOUR LEGAL OBLIGATIONS, INCLUDING BOTH FAVORABLE AND UNFAVORABLE INFORMATION ABOUT YOUR COMPLIANCE WITH THE LEASE CONTRACT, THE RULES, AND FINANCIAL OBLIGATIONS.
